Social media contest terms and conditions
I. General Provisions.

The organizer of the competition is:
SaYu s.r.o., ID No.: 083 20 497, VAT No.: CZ08320497, with its registered office at Červená Skála 338, Řež, 250 68 Husinec, registered in the Business Register kept by the Municipal Court in Prague under No. C 315779, (hereinafter referred to as the "Organizer").

According to these rules, the competition is a consumer competition of social network users - natural persons, based on interaction on the social profiles of the organizer (hereinafter referred to as the "competition"). The competition is not a gambling game within the meaning of Act No. 186/2016 Coll., on gambling. The Organiser announces competitions to promote its company, in particular its brand and its products.

The competition may be announced by publishing a competition announcement:
- on the organiser's official Facebook page: https://www.facebook.com/sayuperiod; or
- on the official profile of the organiser located on the social network Instagram: https://www.instagram.com/sayu_period/
(hereinafter also referred to as "SAYU profile" or collectively "SAYU profiles").
Participation in the competition posted on the SAYU Profiles is judged separately for the competition on each of the SAYU Profiles, even if the competition entry is identical on the SAYU Profiles.

Anyone who meets the conditions for participation in the competition and who completes the competition task defined in the competition announcement becomes a participant. By entering the competition, all participants agree to abide by these rules.

The competition is open to any natural person over 18 years of age with a delivery address in the Czech Republic who is also a fan of SAYU's Facebook profile (in the case of the competition on SAYU's Facebook profile) or a follower of SAYU's Instagram profile (in the case of the competition on SAYU's Instagram profile).

Employees of the organiser and persons close to them are excluded from participation in the competition.

Persons who do not meet the conditions of participation or violate the rules of the competition will be excluded from the competition. Such persons are not eligible to win a prize. If such a person is drawn as a winner, an alternate winner will be drawn instead.

Each entrant may only enter the competition once, and the entrant's identifier is the entrant's personal social media profile/page used to enter the competition.

An entrant will only be entered into the draw once regardless of how many entries they submit to the competition.

Any reactions of the participants are not allowed:
a) to be contrary to generally binding legal regulations or good morals;
b) contain or portray elements of violence, derogatory, offensive, vulgar or otherwise inappropriate content;
c) defame a nation, race, ethnic or other group of persons;
d) incite or approve of criminal or otherwise unlawful activity or incite others to engage in such activity;
e) contain elements or parts to which third parties claim rights, in particular copyright or rights related to copyright, industrial property rights such as trademarks;
f) contain disguised advertising;
g) damage the organiser's reputation in any way

The Organiser reserves the right to exclude from the competition entries that violate these rules, without any compensation and without any obligation to provide reasons for such a decision, and to remove such entries from the SAYU profile without prior notice or to take any other necessary action in accordance with the terms and conditions of the relevant social network.

The Contest Organizer reserves the right to make final decisions in disputed cases at its sole discretion.
II. Privacy Policy and Licensing of Copyright Works.

The Organiser is the controller of the personal data provided by the participant for the purpose of his/her participation in the competition, and the processing of the participant's personal data to the extent specified below is necessary for participation in the competition, its evaluation and the awarding of the prize.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation ("GDPR") and in accordance with Act No. 110/2019 Coll., on the processing of personal data, the organiser of the competition processes the personal data of the participants of the competition, which consists of:

identification, address and contact data of the data subject, namely: name and address of the participant's social network profile, name, surname, e-mail address, delivery address.

The personal data of the data subjects are processed by the controller for the following purposes:
a) the organisation of the competition, including the evaluation of the competition and the publication of the results of the competition in pseudonymised form; the organiser publishes the first letters of the name and surname of the winner and the municipality of residence of the winner (the legal reason consisting in the performance of a contract to which the participant is a party);
b) the handing over of the prizes to the winners of the competition (the legal reason for which is the performance of a contract to which the participant is a party);
c) the internal recording of matters relating to the competition, including statistics (legal reason consisting in the legitimate interest of the administrator). -
The personal data of the data subjects are processed for the duration of the competition and until the expiry of the limitation periods for rights arising from and in connection with the competition.

As a data subject, the contestant is entitled to:
a) request access to his/her personal data;
b) request the rectification, completion or deletion of personal data;
c) request the restriction of the processing of his/her personal data;
d) request an explanation of the processing of his/her personal data;
e) object to the processing of his/her personal data;
f) exercise the right to the portability of his or her personal data;
g) exercise the right to lodge a complaint against the processing of his/her personal data with the Data Protection Authority;
h) to exercise other rights provided for in data protection legislation.

The personal data of data subjects may be transferred to processors solely on the basis of a contract for the processing of personal data with all the safeguards otherwise provided by the controller and to other controllers solely in connection with the performance of the controller's legal obligations, in which cases the recipients may be primarily public authorities. A list of processors can be requested from the competition organiser.

In the event that the competition response (the content added by the participant) or its partial part (in particular the competition photographs, text, audiovisual content) fulfils the characteristics of a copyright work within the meaning of Act No. 121/2000 Coll., on Copyright, on Rights Related to Copyright and on Amendments to Certain Acts, as amended, the competitor grants the organiser a non-exclusive licence (authorisation to exercise the right to use the work) for all uses of the work. The licence is granted without limitation as to quantity, time or place and the organiser is not obliged to use it. The organiser is entitled to sub-license or assign the licence to use the work to a third party. By publishing a competition entry in the competition, the participant guarantees to the organiser that by publishing the content he/she does not infringe the copyright or other intellectual property rights of third parties, or that he/she has duly settled all possible rights of third parties related to the published competition entry and that he/she is liable to the competition organiser for any possible damage that may arise to the competition organiser or other persons as a result of the falsity of this declaration.
III. The mechanism of competition.

The competition will run from the time of its announcement by posting the competition announcement on the relevant social network for the period specified in the relevant competition announcement. The competition announcement shall always contain at least a link to the full text of these rules on the sayu.cz website. If the duration of the competition is not specified, the competition will last for 7 days. For the duration of the contest, the organizer accepts responses from participants to the contest task specified in the contest announcement. A participant's response received in accordance with the specified procedure by the end of the last day of the competition may be included in the competition.

Without undue delay, and no later than 7 days after the end of the competition, the organiser will evaluate the competition responses.

The organiser will select a winner from all the entrants' responses that comply with the competition task as specified in the competition announcement (completion of the task, correct answer to the question, etc.) and other conditions of the competition. The number of winners will always be determined in the respective competition announcement.

The method of selecting the winner from among the participants of the competition is by drawing lots, unless another method of selection is specified in the competition announcement.
IV. Prizes and their delivery.

The prizes in the competition and the number of prizes will always be specified in the announcement of the respective competition.

Each winner will be notified of his/her prize by commenting below the competition announcement/contest entry and will be asked to send the details required to send the prize by email to: kontakt@sayu.cz

The winner is obliged to reply to the prize information message within 3 days, in which he/she is also obliged to provide his/her full name and a valid postal address in the Czech Republic to which the prize will be sent. Without undue delay after receiving the above information necessary to send the prize to the winner, the Organiser will publish in a separate post on the SAYU profile the first letters of the winner's first and last name and the winner's municipality of residence. The Organiser will send the prize to this address within 30 days of the delivery of the winner's email containing the above contact details.

Prizes will be sent by courier to the winner's postal address in the Czech Republic. If the parcel is returned, no further delivery attempt will be made. If the prize is an electronic prize, it will be sent electronically to the winner's email address, who will need to confirm receipt.

In the event that any of the prizes fail to be delivered, handed over, assigned to a specific winner, without any fault on the part of the organizer, or if the winner fails to send his/her answer with full name and delivery address within the specified period, the winner will not receive the prize and an alternative winner will be drawn.

The Organiser shall not be liable for non-delivery of prizes or for any damage, delay or loss of prizes in transit.

Prizes are not enforceable in court. The value of the prizes is always stated after withholding tax, if applicable.

The results of the competition are final. The prizes in the competition represent a voluntary unilateral performance by the organiser, which it would not otherwise be obliged to make, and neither the prizes in the competition nor participation in the competition can be legally enforced, nor can the organiser or the persons with whom the organiser cooperates in the organisation of the competition be required or enforced to make alternative payments. Prizes may not be paid in cash or exchanged for any other non-monetary consideration. Claims for prizes are excluded.

The Organiser accepts no liability whatsoever for any damage caused to entrants by participating in the competition. Neither the winner nor any other participant is entitled to compensation for the costs of participation in the competition.

The Organiser is not obliged to justify the selection of a winner in the competition or the elimination of a participant from the competition.
V. Final Provisions.

The rules of the competition respect the rules of the social network Facebook / Instagram. The Contests are in no way run by, sponsored by, or associated with the operators of Facebook / Instagram and such operators are not responsible for the operation of the Contest. Information provided in the context of the contests will not be disclosed in any way to this company by the organizer. Any questions, comments or complaints regarding the contests must be directed to the organizer and not to the operator of Facebook / Instagram.

The competition rules are published on the company's website www.sayu.cz.

Each participant is required to read these rules, which become binding upon them by participating in the competition.

The competition organizer is entitled to change, shorten, extend, cancel or modify the competition rules at any time if the circumstances of the competition so require.

In the event that changes are made to the terms and conditions of the competition, they will be made in the form of an addendum to these rules and will be published on the Facebook or Instagram page in a comment below the competition entry and/or in a separate post.

Requests, complaints or other queries, including objections to the processing of personal data, may also be sent to the Organiser by email to, among others: sayu@sayu.cz.

The Competition Rules, including any changes thereto, shall come into force at the moment of their publication on the Organiser's website.
